Lease agreements
In Spain, lease contracts, also known as rental contracts, are legal agreements between the lessor (owner of the property) and the lessee (tenant), whereby the lessor assigns the use of a property in exchange for a periodic rent.
Lease agreements in Spain are governed by the Urban Leases Law (LAU), which establishes the rules and conditions applicable to rental agreements for housing and premises.
The main aspects of leasing contracts in Spain are described below:
- Duration: Lease agreements may be for a fixed or indefinite term, as agreed between the parties. In general, residential leases have a minimum term of 3 years, while commercial leases may have a shorter term.
- Deposit: The tenant is obliged to deposit a deposit equivalent to one or two months’ rent, which will be returned at the end of the contract if the established obligations are fulfilled.
- Rent and expenses: The tenant is obliged to pay the rent established in the contract within the agreed terms. In addition, the lease must state which expenses are to be borne by the tenant and which are to be borne by the lessor (such as community fees, utility bills, etc.).
- Obligations of the tenant: The tenant is obliged to conserve and maintain the property in good condition, to use it responsibly and to respect the rules of coexistence in the community of owners.
- Obligations of the lessor: The lessor is obliged to deliver the property in habitable condition and to carry out the necessary repairs for its conservation. It must also respect the tenant’s right to use and enjoy the property without interference.
- Termination of the contract: The contract may be terminated by mutual agreement between the parties or for breach of any of the obligations set forth in the contract. In general, the termination of the contract must be communicated in writing and at least one month in advance.
It is important to bear in mind that lease contracts in Spain may vary depending on the particularities of the property and the circumstances of the parties, so it is advisable to seek specific advice before entering into a lease contract.
